Black Girl Magic, A Lesson In Trademark Restraints

Black Girl Magic is a popular, wide known movement and is incapable of being a brand identifier and thus cannot be owned exclusively by anyone. We see the declaration of Black Girl Magic everywhere. It is a message of power and perseverance. Not the source indicator of any kind. This argument has been presented by Essence Magazine in their trademark dispute with Beverly Bond, the founder of Black Girls Rock. I imagine that the Trademark Trial and Appeal Board’s decision will be in line with their previous decisions where they found that the similar marks do not “function as a mark to identify and distinguish the applicant’s goods”

Before I continued posting to these topics I checked out the trademark.
The above are the results of my search.
Beverly Bond or Essence.
Words can’t be trademarked unless on clothing or something.

When the white woman stole METOO they at least offered the founder to join them in the movement.
Beverly Bond nor Essence are contacting or mentioning CaShawn Thompson, the founder of the movement, Black Girls Magic.

They’re going to court over a Movement name, created by another Black girls magic.

Beverly Bond and Essence are Black Girls not rocking and have no Black Girl Magic.
We can do each other so wrong sometimes.

Don’t bother trying to look up “Black Girl Magic“ in the dictionary, because it isn’t there — at least not yet. But we’re sure you’ve seen or heard the phrase plenty of times over the past year and are wondering what it means. Well, it was created by CaShawn Thompson to celebrate the beauty, power and resilience of black women. And boy are we glad that she did!

The Copyright fight is over Black Girls Magic.

Essence and The Beverly Bond are not the only ones looking to Copyright the phase.
