Is there anyone who is familiar with a case that has happened in the past 5 years that is an example of whatever elements make for one of those two things I listed as my title headline? I have been looking and looking and having a hard time digging some up. Any ideas?

I don't know much about law or the exact details of this case or whether this case is still open.

You may be better served leafing through a copy of the book "Restatement of the Law" with particular emphasis on torts.

As to case law, you should look to the case law created by your State.
